Acceptance of terms of service

By using the instamapper.com site and/or GPS tracking software (collectively referred to as "the Service"), you agree to be bound by these Terms of Service (the "Agreement").

General terms

• We do not allow covert tracking. You may not use our service to track a person without his or her consent, or track an object without the permission of its owner.
• You may not use the Service where such use is illegal. It is your responsibility to ensure that your intended use of GPS tracking does not violate local, state or federal laws.
• InstaMapper's GPS tracking software installed on a cell phone is intended to be used in conjunction with an unlimited data plan. You are warned that you may incur substantial data charges should you decide to use our service without an unlimited data plan. Under no circumstances shall InstaMapper be liable for any charges billed by your cell phone company.
• You should be aware that we make no guarantees about the reliability or continuity of our service. We reserve the right to pause or terminate your service at any time without notice. We will not be liable for any losses, either direct or indirect, that such interruption or termination may cause you. Use the service at your own risk.
• You may not send automated requests to InstaMapper, attempt to circumvent InstaMapper's authentication measures, reverse engineer our software or protocols, and otherwise engage in activities that we deem damaging to our service.
• We cannot be responsible for the content of messages posted to the forums section (http://forums.instamapper.com) of our site.
• You may not profit from our service in any way without prior written authorizatrion from InstaMapper LLC. In particular, you are not allowed to sell cell phones with preinstalled InstaMapper tracking software.

Privacy policy

We take your privacy very seriously. Our privacy policy is available at http://www.instamapper.com/privacy.html. By accepting the Terms of Service, you agree to be bound by our privacy policy.

Indemnification

You agree to indemnify and hold InstaMapper LLC, its affiliates, officers and employees, harmless, including costs and attorneys' fees, from any claim or demand made by any third party due to your use of the Service, your violation of the Terms of Service, and/or your violation of any other right of any person or entity.

Disclaimer

USE OF THIS SERVICE IS PROVIDED "AS IS, WHERE IS," AS AN ACCOMMODATION, AND WITHOUT WARRANTY OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF TITLE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL INSTAMAPPER LLC BE LIABLE FOR DAMAGES OF ANY KIND TO YOU FOR ANY DEFICIENCY, ERROR, OR INTERRUPTION IN THE SERVICE PROVIDED HEREUNDER. YOUR SOLE REMEDY IN THE EVENT OF ANY DEFICIENCY OR ERROR SHALL BE TO REQUEST THAT INSTAMAPPER LLC CORRECT THE MATTER OR INFORMATION PROVIDED OR, IF INSTAMAPPER LLC FAILS TO DO SO, TO DISCONTINUE USE OF THE SERVICE AT YOUR OPTION.

Changes to Terms of Service

InstaMapper LLC may change this Agreement at any time for any reason by posting the modified Agreement on its website. Your continued use of the Service after a modified Agreement is posted shall be acceptance of the new Agreement. If you do not agree with the modified Agreement, you must stop using the Service.

Governing law

This Agreement shall be governed by the laws of the State of Washington. Should a dispute arise, you agree that any legal proceedings against InstaMapper LLC shall be initiated in a state or federal court located in King County, Washington.
